Regulation of the state of emergency

It was published the Decree No 2-A/2020, of 20 March, which regulates the application of the state of emergency decreed by the President of the Republic. The Decree stipulated a general duty of home pick-up, but safeguarded the need to travel for imperative family reasons, which include travel for the assistance of vulnerable persons, persons with disabilities, children, parents, the elderly or dependents. During this period, the following shall be subject to a special duty of protection:
- a) Those over 70 years of age;
- Immunodepressed and chronically ill patients who, according to the guidelines of the health authority, should be considered at risk, namely hypertensive patients, diabetics, cardiovascular patients, patients with chronic respiratory disease and cancer patients.
These citizens may only circulate in public spaces and roads, or in private spaces and roads assimilated to public roads, for any of the following purposes:
- a) Acquisition of goods and services;
- b) Travel for health reasons, namely for the purpose of obtaining health care;
- c) Travel to post offices, banking agencies and agencies of insurance brokers or insurers;
- short-term physical activity trips, where the exercise of collective physical activity is prohibited;
- short-term journeys for the purpose of pet walking;
- other activities of a similar nature or for other reasons of force majeure or unavoidable necessity, provided that they are duly justified.
Special rules for priority care were also established during this period. Thus, retail or service establishments that maintain their activity in accordance with the preceding articles must give priority to persons subject to a special duty of protection, in accordance with the aforementioned, as well as health professionals, members of the security forces and services, protection and relief, personnel of the armed forces and the provision of social support services.
The persons responsible for the establishments must clearly and visibly inform the right to priority care provided for in the preceding paragraph and take the necessary measures to ensure that it is carried out in an organised manner and in compliance with hygiene and safety rules.
